Welcome to Motley Pups Collection.
These Terms & Conditions (“Terms”) govern your use of www.themotleybrand.co.za and your purchase of products from Motley Pups Collection (“Motley Pups”, “MPC”, “we”, “us” or “our”).
Motley Pups Collection is a brand operated by The Motley Brand, a sole proprietorship in South Africa.
By using our website or placing an order with us, you agree to these Terms, together with any product-specific terms or information displayed on the relevant product page.
Nothing in these Terms is intended to exclude or limit any consumer right or protection that cannot lawfully be excluded or limited under South African law.

2. Applicable Law
These Terms are governed by the laws of the Republic of South Africa.
Our online transactions are subject to applicable South African legislation, including, where applicable:
- The Consumer Protection Act 68 of 2008 (“CPA”);
- The Electronic Communications and Transactions Act 25 of 2002 (“ECTA”);
- The Protection of Personal Information Act 4 of 2013 (“POPIA”);
- Other applicable laws and regulations.
Where a provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory legal provision will prevail.
3. Products
We create and sell products for dogs and their people, including handmade, homemade, personalised and ready-made products.
Product descriptions, photographs, dimensions, colours, materials and other information are provided to help customers make informed purchasing decisions.
Because many MPC products are handmade or individually prepared, minor variations in appearance, texture, colour, finish and dimensions may occur.
Such natural or handmade variations are not necessarily defects.
We will, however, make reasonable efforts to ensure that products correspond with their descriptions and representations on the website.
4. Product Availability
All products are subject to availability.
We reserve the right to discontinue products or make reasonable changes to products, provided that such changes do not unlawfully affect an order already accepted.
If we cannot fulfil an accepted order, we will contact you and provide an appropriate remedy in accordance with applicable law.
5. Handmade, Homemade and Personalised Products
MPC includes products that are:
- Handmade;
- Homemade;
- Made to order;
- Personalised or customised.
These products may require additional preparation time.
Dispatch timeframes
Unless a product page states otherwise:
Ready-made products:
We aim to dispatch orders within approximately 48 hours.
Personalised, handmade and homemade products:
We aim to dispatch orders within approximately 5–7 business days.
These are dispatch timeframes, not guaranteed delivery timeframes.
Delivery after dispatch depends on the selected delivery method, courier network, destination and circumstances outside our reasonable control.
6. Personalised Products
Where a product is personalised, you are responsible for providing accurate personalisation information.
This may include:
- Pet names;
- Spelling;
- Capitalisation;
- Names or wording;
- Other customisation instructions.
We will generally reproduce the information you provide.
Please check your personalisation information carefully before completing your order.
Because personalised products are made specifically for you, we generally cannot accept a change-of-mind return or cancellation once production has commenced, subject always to any rights you may have under applicable law.
7. Prices
All prices displayed on the website are in South African Rand (ZAR) unless otherwise stated.
The applicable price will be the price displayed at the time you place your order.
Where delivery charges apply, these will be communicated before you complete the purchase.
We reserve the right to correct obvious pricing or typographical errors. If an obvious error affects an order you have placed, we will contact you before proceeding where reasonably possible.
8. Orders
When you place an order, you are making an offer to purchase the selected products.
Your order will be processed once payment has been successfully received and the order has been accepted by us.
An automated order confirmation does not necessarily constitute acceptance where the order cannot reasonably be fulfilled.
We may contact you if information required to complete your order is missing, incorrect or unclear.
9. Payment
Online payments are processed through PayFast.
We may also make other payment methods available from time to time.
Orders will generally only enter production or fulfilment once payment has been successfully confirmed.
We do not intentionally store complete payment card information on our own website.
10. Delivery
We currently deliver within South Africa.
Orders may be dispatched using The Courier Guy or another delivery service selected by MPC.
The customer is responsible for providing a complete and accurate delivery address and contact details.
Delivery timeframes are estimates and may be affected by:
- Courier delays;
- Weather;
- Public holidays;
- Remote-area delivery;
- Incorrect or incomplete address information;
- Events outside our reasonable control.
Where an order is returned to us because the customer supplied an incorrect address or was unavailable to receive the delivery, additional delivery charges may apply where permitted by law.
11. Local Collection
Local collection is available from the MPC Centurion Home Studio.
Collection arrangements will be communicated to the customer after the order has been confirmed.
Customers should not arrive for collection without first receiving confirmation that the order is ready.
12. Returns and Change of Mind
MPC does not ordinarily accept returns simply because a customer has changed their mind, selected the wrong product, changed their preferences or no longer wants the product.
This is particularly important for personalised, handmade and homemade products.
However, this policy does not exclude any statutory cancellation, return, repair, replacement or refund rights that apply to a transaction under South African law.
Certain electronic transactions may also be subject to statutory cooling-off rights and exceptions under ECTA.
Where a statutory right applies, that right will take precedence over this policy.
13. Defective, Unsafe or Incorrect Products
We want every Motley Pups product to reach you in the condition you reasonably expect.
If you receive a product that is:
- Defective;
- Unsafe;
- Materially damaged before or during delivery;
- Incorrect;
- Not reasonably fit for its intended purpose; or
- Otherwise fails to meet applicable statutory requirements,
please contact us as soon as reasonably possible.
Under the CPA, qualifying goods are subject to an implied warranty of quality. In qualifying circumstances, a consumer may return goods within six months of delivery and may be entitled to a repair, replacement or refund as provided by the Act.
We will assess the issue and provide the remedy required by applicable law.
We may ask for photographs, videos or other reasonable information to help us understand the problem.
14. Damaged-on-Delivery Products
If your order arrives visibly damaged, please contact us as soon as reasonably possible and provide photographs of:
- The product;
- The packaging;
- Any visible damage;
- The shipping label where applicable.
This helps us investigate the matter with the courier.
Nothing in this section limits any statutory rights you may have.
15. Repairs
We understand that dogs have opinions about how long a toy or enrichment product should remain intact. Those opinions are not always aligned with ours.
Where a product has been damaged through ordinary use and the damage is repairable, MPC may offer a repair service.
Repairs requested because of normal use, chewing, pulling, tearing, destructive behaviour, accidental damage or other damage that is not attributable to a defect may be offered at the customer’s cost.
The repair cost will depend on the nature and extent of the damage and will be communicated before the repair is undertaken.
Where a product is defective or otherwise subject to a statutory remedy, this repair policy does not limit the customer’s legal rights.
16. Dog Treats and Homemade Products
MPC’s homemade treats are intended for dogs only.
Treats should be used as directed and stored according to the instructions provided with the product.
Customers are responsible for considering their dog’s:
- Individual dietary needs;
- Known allergies or intolerances;
- Health conditions;
- Age;
- Size;
- Feeding requirements.
Where you are unsure whether an ingredient or treat is appropriate for your dog, consult your veterinarian.
MPC does not provide veterinary, medical or individualised nutritional advice.
Treats should be introduced appropriately and dogs should be supervised while eating.
The customer is responsible for ensuring that treats are stored correctly and are not consumed after their recommended use-by or freshness period.
17. Ingredients and Allergies
We will provide ingredient information where applicable.
Because individual dogs can react differently to ingredients, the customer is responsible for checking the ingredient information before giving a product to their dog.
If your dog has a known allergy, intolerance or dietary restriction, please contact us before ordering if you need clarification about ingredients.
We cannot guarantee that a dog will not experience an individual reaction to an ingredient.
Where a customer has not disclosed a relevant dietary requirement, we cannot be responsible for a customer’s decision to provide a product that is unsuitable for their dog.
18. Dog Toys and Enrichment Products
MPC toys and enrichment products are designed to encourage play, exploration and enrichment.
They are not guaranteed to be indestructible.
Dogs vary considerably in their chewing strength, play style and behaviour.
Owners should:
- Select products appropriate for their dog’s size and play style;
- Supervise dogs when using toys and enrichment products;
- Regularly inspect products for damage;
- Remove damaged products from use;
- Replace products when they become unsafe.
MPC cannot be responsible for damage caused by misuse, inappropriate use, failure to supervise, excessive chewing or normal wear and tear, subject to any statutory rights that may apply.
19. Product Safety
Customers are responsible for following any safety, care, storage or use instructions supplied with a product.
A product should not be used in a manner contrary to its intended purpose or supplied instructions.
If you believe that a product may be unsafe, stop using it and contact us immediately.
20. Website Content
We make reasonable efforts to ensure that information on our website is accurate and current.
However, we do not guarantee that every piece of website content will always be completely accurate, current or free from typographical errors.
Product colours may appear differently depending on the customer’s monitor, screen or device.
21. Intellectual Property
Unless otherwise stated, the content of the Motley Pups website and brand, including:
- Logos;
- Brand elements;
- Illustrations;
- Product photography;
- Original artwork;
- Text;
- Graphics;
- Designs;
- Product concepts;
- Website content;
belongs to or is used by The Motley Brand / Motley Pups Collection with the appropriate rights.
You may not reproduce, copy, modify, distribute, sell or commercially exploit our content without our prior written permission, except where permitted by law.
22. Customer-Supplied Content
If you voluntarily submit photographs, reviews, testimonials or other content to MPC, you confirm that you have the necessary rights to provide that content.
If we intend to use customer-submitted content for marketing purposes, we will do so in accordance with the permission, agreement or terms applicable to the submission.
We reserve the right not to publish or to remove submitted content that is inappropriate, unlawful, misleading or otherwise unsuitable.
23. Reviews
Customers are welcome to provide honest reviews of products they have purchased.
Reviews should not contain unlawful, defamatory, threatening, abusive or misleading material.
We reserve the right to moderate or remove reviews where reasonably necessary.
We will not require customers to provide positive reviews.
24. Promotions and Discounts
Promotional offers, discount codes and special offers may be subject to additional terms stated at the time of the promotion.
Unless expressly stated otherwise:
- Promotions cannot be exchanged for cash;
- Discount codes cannot be combined;
- Promotions cannot be applied retrospectively to completed orders;
- A promotion may have an expiry date or product limitation.
Nothing in a promotion limits a consumer’s statutory rights.
25. Third-Party Services
Our website may rely on third-party providers, including payment processors, couriers, hosting providers, email marketing services and other technology providers.
Third-party services may be governed by their own terms and privacy policies.
We are not responsible for the independent actions or policies of third-party providers, except to the extent that applicable law provides otherwise.
26. Website Availability
We aim to keep the website available and functioning properly but cannot guarantee uninterrupted access.
The website may occasionally be unavailable due to:
- Maintenance;
- Updates;
- Hosting problems;
- Technical faults;
- Security incidents;
- Events outside our reasonable control.
27. Events Outside Our Reasonable Control
We will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including significant courier disruptions, natural disasters, power or internet failures, strikes, government restrictions, widespread technical failures or other events that could not reasonably have been prevented.
Where such an event occurs, we will make reasonable efforts to communicate with affected customers.
28. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by South African law.
Subject to applicable law, MPC will not be liable for loss arising from:
- Misuse of a product;
- Use contrary to supplied instructions;
- Failure to supervise a dog using a toy or enrichment product;
- Failure to store treats correctly;
- Providing treats to a dog despite a known allergy or dietary restriction;
- Normal wear and tear;
- Damage caused by destructive chewing or inappropriate use;
- Incorrect information supplied by the customer;
- Delays caused by third-party delivery providers or circumstances outside our reasonable control.
This section does not limit any rights or remedies available to consumers under applicable law.
29. Complaints
We genuinely want to resolve problems directly with our customers wherever possible.

We will consider complaints fairly and in accordance with applicable law.
30. Consumer Rights
Nothing in these Terms is intended to deprive a consumer of any right provided by the CPA, ECTA, POPIA or another applicable South African law.
Where applicable legislation gives you a right that differs from these Terms, the statutory right will apply.
The CPA establishes consumer rights concerning product quality and provides statutory remedies for qualifying defective goods.
ECTA also requires online suppliers to make information concerning the supplier, products, pricing, payment, delivery, returns and privacy available to consumers. These Terms are intended to provide that information in an accessible form.
31. Privacy
Our collection and processing of personal information is governed by our Privacy Policy, which forms part of the information governing your interaction with Motley Pups.
Our Privacy Policy explains how we collect, use, protect and retain personal information and how you may exercise your privacy rights.
32. Changes to These Terms
We may update these Terms from time to time.
The latest version will be published on this page with the date on which it was last updated.
Changes will not retrospectively remove rights that a consumer has already acquired under applicable law.
33. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law and any applicable consumer dispute-resolution mechanisms.
Nothing in these Terms prevents a consumer from exercising a statutory right to approach an appropriate regulatory or dispute-resolution body.
